Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Piksi ("the app"), you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

2. Description of Service

Piksi is a vocabulary capture app that allows you to capture unknown words from any text, look up definitions via an offline dictionary, and review them using spaced repetition. The app works without an account, with optional paid features.

3. User Accounts

Piksi does not require an account. All data is stored locally on your device.

Cloud sync and certain features require an account (email, Apple Sign-In, or Google Sign-In via Firebase Authentication). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Purchases & Payments

• Paid features are available as a monthly auto-renewing subscription at $4.99 USD/month, or a one-time lifetime purchase at $19.99 USD. Equivalent prices are displayed in the app in your local currency.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price. You can manage or cancel your subscription at any time in your device’s account settings (Apple ID or Google Play).
• All purchases are non-refundable, except as required by applicable law or the respective store’s refund policy.
• Purchase validation is handled by RevenueCat, a third-party service that verifies your receipt with the store. Your purchase can be restored on any device by signing in with the same store account.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the app
• Attempt to gain unauthorized access to the app’s servers or systems
• Use the app for any unlawful purpose
• Interfere with or disrupt the integrity or performance of the app
• Redistribute, sublicense, or resell the app or any part of it

6. Intellectual Property

The app, including its design, code, features, and branding, is the property of Piksi and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

Dictionary data is sourced from open-source linguistic databases and is bundled locally within the app. The data remains subject to its original open-source license terms.

7. User Content

Words you capture, session data, and review progress constitute your content. You retain ownership of your content. By using cloud sync, you grant us a limited license to store and transmit your content solely for the purpose of providing the sync service.

8. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Piksi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the app, regardless of the theory of liability.

10. Data & Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Termination

We may suspend or terminate your access to the app at any time for violation of these terms. You may stop using the app at any time. Upon termination, your right to use the app ceases immediately. You can delete all local data by uninstalling the app. Users with an account can delete their account and all synced data from Settings within the app.

12. Changes to These Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the app after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
